The Commercial Function is accountable for the overall commercial risk framework in relation to client (sales) deals, contracts end-to-end, including any third parties and suppliers.
Responsibilities
Responsible for commercial activities in support of Programme/Transformation projects ensuring commercial deal shape is well defined and that supply chain contracts are aligned to deliver.
Drafting of client and supplier contracts and/or amendments and where required, setting up new internal/external supplier contracts to support the Programme.
Ongoing management and support of Fixed Price implementation activities, working closely with Programme team to ensure Milestone deliverables are on track, accurately provided to Client on time, any delivery risk/delays are clearly reported/managed on timely basis and in line with the contract and any scope/cost changes are managed in accordance with the Change Control process.
Commercial management of supply chain to ensure delivery of the Fixed Price Programme in line with our requirements and on budget.
Attendance and contribution relating to commercial matters at Programme governance meetings/escalation/client meetings as required.
Change Management - ensure contracts / contract variations / new projects are appropriately governed and approved in line with Capita policy, prior to submission/signature.
Identify, manage and report on key commercial / legal risks (legal risks to be communicated to Legal function and ongoing appropriate support / liaison to be maintained).
Support & advise on commercial disputes, lead settlement negotiations and define and record settlement terms (except in case of formal dispute / litigation).
About You
Experienced commercial individual who has track record in bidding for, negotiating and/or managing significant sales & supplier contracts.
Has commercial and contracts experience and demonstrable track record of owning and delivering pre and post contract activity,
Experienced in defining, driving and overseeing commercial & contract governance.
Excellent written and verbal communication skills
Strong & confident communicator able to successfully engage and influence at all levels of the organisation, including up to Divisional Management and senior members of Functional Teams.
Champion to both the business and the Commercial function as a cross-functional leader and internal influencer.
